Texas Notaries Public are governed by Chapter 406 of the Government Code, Chapter 121 of the Civil Practice and Remedies Code and the Secretary of State’s Administrative rules found in 1 Texas Administrative Code Chapter 87, as well as any other applicable State or Federal Law.

Notary has the right to refuse notarization of documents if the signer appears hesitant, unwilling without coercion, duress, or intimidation, under the influence of drugs/alcohol/medication or otherwise has the capacity/awareness of what is being signed.

The notary must be able to talk back and forth with the signer without a translator. Both the notary and the signer must be able to understand each other.

At this time the only language the notary speaks is ENGLISH.


To be acceptable for notarization in Texas, identification must be valid, non-expired, and have a photograph. Acceptable forms of identification include:

  • Valid Driver’s License or VALID State Issued ID Card, issued by any US state with the individual’s photo and signature.

  • USA Passport.

  • State driver’s and official nondriver’s IDs with the individual’s photo and signature.

  • U.S. military IDs and resident alien IDs or “green cards” issued by the U.S. Citizenship and Immigration Services with the individual’s photo and signature.

  • A picture ID issued by a state or federal government agency with the individual’s photo and signature.
